Terms of Service

Think Talk (“Think Talk,” “we,” “us,” or “our”) provides websites, apps, and related services that let people publish content, connect with others, and grow their presence (collectively, the Service). By accessing or using the Service—including creating an account, browsing public pages, or submitting content—you agree to these Terms of Service (Terms). If you do not agree, do not use the Service.
These Terms apply together with our Privacy Policy and Cookie Policy. Capitalized terms used in integrated features (for example, verification or rankings) may also be described in product Help or feature-specific terms where we provide them.
1. Who may use the Service
You must meet the minimum age required in your country or region to enter into a binding agreement (often 18, or the age of digital consent such as 13 in the United States with parental consent where required). If you use the Service on behalf of a company or organization, you represent that you have authority to accept these Terms on its behalf.
2. Accounts and security
You are responsible for safeguarding your credentials and for all activity under your account. Provide accurate registration information and keep it updated. Notify us promptly through the contact channels listed on the site if you suspect unauthorized access. We may take reasonable steps to secure the Service but cannot guarantee that unauthorized third parties will never defeat those measures.
3. Acceptable use
You agree to use the Service only for lawful purposes and in line with our community expectations. Without limiting the foregoing, you must not:
- Violate applicable laws or regulations, or promote illegal activity.
- Harass, threaten, abuse, stalk, or discriminate against others.
- Post content that infringes intellectual property, privacy, publicity, or other rights of third parties.
- Distribute malware, conduct phishing, or attempt to disrupt, overload, or bypass security or rate limits.
- Scrape, crawl, harvest, or use automated means to access the Service except as allowed by our robots.txt policy or with our prior written consent.
- Impersonate any person or entity, or misrepresent your affiliation.
- Upload sexually explicit material involving minors, or other content that is unlawful or harmful to minors where prohibited.
- Spam, manipulate metrics, or artificially inflate engagement.
We may investigate violations and cooperate with law enforcement where appropriate.
4. Your content and license
You retain ownership of the content you create and post, subject to the rights you grant below.
By posting Your Content on the Service, you grant Think Talk a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, publish, display, distribute, and otherwise use Your Content as reasonably necessary to operate, provide, secure, improve, and promote the Service—including formatting, transcoding, backup, and accessibility adaptations.
You represent and warrant that you have all rights necessary to grant this license and that Your Content does not violate these Terms or applicable law. You may delete certain content subject to technical limits and backup retention; residual copies may persist for a limited period in ordinary course.
5. Our intellectual property
The Service—excluding Your Content—including software, branding, logos, designs, and documentation, is owned by Think Talk or its licensors and protected by copyright, trademark, and other laws. Except as expressly allowed, you may not copy, modify, distribute, sell, or lease any part of the Service or our trademarks.
6. Third-party links and integrations
The Service may contain links to third-party sites or integrate third-party services. Those third parties are responsible for their own terms and practices. Think Talk does not control and is not responsible for third-party content, products, or services.
7. Changes to the Service and Terms
We may modify, suspend, or discontinue features of the Service from time to time. We may also update these Terms. When we make material changes, we will provide notice in a reasonable manner (for example, by posting an updated policy, banner, or email where appropriate). Your continued use after the effective date of changes constitutes acceptance. If you do not agree, you should stop using the Service.
8. Suspension and termination
We may suspend or terminate access to the Service—temporarily or permanently—if you materially breach these Terms, if we are required to do so by law, or to protect the Service or other users. You may stop using the Service at any time. Provisions that by their nature should survive (including license grants to the extent needed to operate residual copies, disclaimers, limitations, indemnity, and governing law) will survive termination.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, THINK TALK DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Some jurisdictions do not allow certain disclaimers; in those jurisdictions, disclaimers apply to the fullest extent permitted.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THINK TALK AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNTS YOU PAID THINK TALK FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY (IF ANY).
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.
11. Indemnity
You agree to indemnify and hold harmless Think Talk and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of Your Content, your use of the Service, or your violation of these Terms or applicable law.
12. General
Governing law. These Terms are governed by the laws of the jurisdiction in which Think Talk primarily operates, without regard to conflict-of-law principles, unless mandatory consumer protection laws in your country require otherwise.
Entire agreement. These Terms, together with the Privacy Policy and Cookie Policy and any feature-specific terms we provide, constitute the entire agreement between you and Think Talk regarding the Service.
Severability. If any provision is held invalid, the remaining provisions remain in effect.
No waiver. Failure to enforce any provision is not a waiver of our rights.
Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
